Makes provisions regarding the Brazilian Forum on Climate Change and makes further provisions.
THE PRESIDENT OF THE REPUBLIC, exercising the power conferred upon him by art. 84, item VI, of the Constitution,
DECREES:
Art. 1 The Brazilian Forum on Climate Change was created by Decree no. 3,515, of June 20, 2000, with the purpose of raising the awareness of society and mobilizing it for the discussion and decision-making about the problems resulting from climate change caused by greenhouse gases, as well as the Clean Development Mechanism (CDM) defined under Article 12 of the Kyoto Protocol to the United Nations Framework Convention on Climate Change, ratified by the National Congress by means of Legislative Decree no. 1, of February 3, 1994.
Art. 2 The Forum shall be composed as follows:
I - Ministers of State:
a) of Science and Technology;
b) of Development, Industry and Foreign Commerce;
c) of Agriculture and Supply;
d) of Environment;
e) of External Relations;
f) of Mines and Energy;
g) of Planning, Budgeting, and Management;
h) of Health;
i) of Transports;
j) of Education;
l) of Defense;
m) Head of the Civil House of the Presidency of the Republic.

II - Director-President of the National Agency of Waters - ANA;

III - representatives of the civil society with outstanding knowledge of the issue, or that were given responsibility for climate change issues.

IV - as invitees:
a) the President of the House of Representatives;
b) the President of the Federal Senate;
c) State Governors;
d) Mayors of state capitals.

§ 1 The Forum shall be presided by the President of the Republic, who shall convene the meetings of the Forum.
§ 2 The members referred to in item III shall be designated by the President of the Republic.

Art. 3 The Forum shall be permanently integrated with the Interministerial Commission on Global Climate Change, created by the Decree of July 7, 1999, viewing the adoption of the necessary measures for the implementation of the decisions reached at the Forum.
Art. 4 The Forum shall have an Executive Secretary, to be designated by the President of the Republic, who will be responsible for:
a) participating of the meetings of the Forum;
b) organizing the agenda of the meetings;
c) adopting the necessary measures for the execution of the work of the Forum and its thematic boards.
Sole paragraph. The Executive Secretary may request the necessary technical support from the bodies referred to in the sole paragraph of Article 5 for fulfilling his or her attributions.
Art. 5 The Forum shall constitute, under the coordination of any participant, provisional or permanent thematic boards to convene the several economic, social, technical, and scientific sectors of the country responsible for the implementation of measures related to the United Nations Framework Convention on Climate Change.
Sole paragraph. The thematic boards shall rely on the technical support of the following bodies and entities of the Federal Public Administration:
I - National Electrical Energy Agency - ANEEL;
II - National Petroleum Agency - ANP;
III - Central Bank of Brazil - BCB;
IV - National Bank for Social and Economic Development - BNDES;
V - Brazilian Securities Commission - CVM;
VI - Studies and Projects Financing Institution - FINEP;
VII - Brazilian Institute for Geography and Statistics Foundation - IBGE;
VIII - Institute of Applied Economics Research Foundation - IPEA;
IX - National Institute for Space Research - INPE;
X - Brazilian Company for Agricultural Research - EMBRAPA;
XI - other governmental bodies or entities supported with public resources.
Art. 6 The administrative support and the necessary means for the execution of the work of the Forum and the thematic boards shall be provided by the Ministry of Science and Technology, if budgetary resources are available.
Sole paragraph. Any expenses with per diems and tickets for the members of the Forum and of the thematic boards shall be incurred by the bodies they represent.
Art. 7 The Forum shall encourage the creation of State Climate Change Fora, and shall carry out public hearings in the different regions of the country.
Art. 8 The positions of Executive Secretary and member of the Forum and of the thematic boards shall not be remunerated, as they are considered of relevant public interest.
Art. 9 This Decree shall come into force on the date of its publication.
Art. 10 Decree no. 3,515 of June 20, 2000 is hereby revoked.
