Creates the Interministerial Commission on Global Climate Change, with the purpose of articulating governmental actions in this area.
THE PRESIDENT OF THE REPUBLIC, exercising the power conferred upon him by art. 84, item II, of the Constitution,
DECREES:
Art. 1. It is hereby created the Interministerial Commission on Global Climate Change, with the purpose of articulating governmental actions resulting from the United Nations Framework Convention on Climate Change and its subsidiary instruments in which Brazil takes part.
Art. 2. The Commission shall be composed of one representative from each body indicated below:
I. Ministry of External Relations;
II. Ministry of Agriculture and Supply; (wording amended by Decree of January 10, 2006)
III. Ministry of Transports;
IV. Ministry of Mines and Energy;
V. Ministry of Planning, Budgeting and Management; (wording amended by Decree of January 10, 2006)
VI. Ministry of Environment;
VII. Ministry of Science and Technology;
VIII.Ministry of Development, Industry and External Commerce; (wording amended by Decree of January 10, 2006)
IX. Civil Office of the Presidency of the Republic;
X. Ministry of Cities; (wording amended by Decree of January 10, 2006)
XI. Ministry of Finance. (wording amended by Decree of January 10, 2006)
§ 1 The Ministers of State for Science and Technology and Environment shall be, respectively, the president and vice-president of the Commission.
§ 2 The members of the Commission and respective alternate members shall be indicated by the office holders of the bodies represented and designated by the Minister of State for Science and Technology.
§ 3 The Ministry of Science and Technology shall hold the position of Executive Secretariat of the Commission and shall provide technical and administrative support to the works of the collegiate.
§ 4 The members of the Commission shall act in a coordinate way and shall provide information to the Executive Secretariat relative to their area of competence.
§ 5 The Commission shall request the collaboration of other public or private bodies and representative entities of the civil society in the fulfillment of its attributions.
§ 6 The Executive Secretary of the Brazilian Climate Change Forum, referred to in Article 4 of the Decree of August 28, 2000, shall attend the meetings as observer, upon discretion of the president of the Commission. (wording amended by Decree of January 10, 2006)
Art. 3. The attributions of the Commission are:
I - to provide a statement, whenever requested, on proposals for sectoral policies, legal instruments and norms that contain a relevant component for the mitigation of global climate change and the country’s adaptation to its impacts;
II - to provide inputs on the Government’s positions in the negotiations under the United Nations Framework Convention on Climate Change and subsidiary instruments in which Brazil takes part;
III - to define eligibility criteria additional to those considered by the bodies of the Convention in charge of the Clean Development Mechanism (CDM), as provided for in Article 12 of the Kyoto Protocol to the United Nations Framework Convention on Climate Change, pursuant to national sustainable development strategies;
IV - to analyze statements on projects that result in emission reduction and that are considered eligible to the Clean Development Mechanism (CDM), as referred to in the previous item, and approve them, when appropriate;
V - to establish agreements with representative entities of the civil society, in order to promote actions by governmental and private bodies with a view of meeting the commitments accepted by Brazil under the United Nations Framework Convention on Climate Change and subsidiary instruments of which Brazil is part;
VI - to approve its rules of procedure.
Art. 4. This decree shall come into force on the date of its publication.

Provides a new wording to Article 2 of the Decree of July 7, 1999, which creates the Interministerial Commission on Global Climate Change.
THE PRESIDENT OF THE REPUBLIC, pursuant to the authority vested in him by Article 84, item VI (a), of the Constitution,
